www.flowerme.hu (the “Site”) is operated by Maria Mihaela Tom sole trader as flowerMe (“flowerMe” or “We”). When you use the Site, you agree to the terms and conditions that follow. These terms and conditions also govern the supply of any goods to you by flowerMewhether facilitated by the Site or by any other means. If you do not agree to these terms and conditions, you should immediately cease use of the Site. The use of the Site and the provision of goods to you by flowerMe is conditional on your acceptance without modification of the terms and conditions.

These terms and conditions supersede and exclude all prior and other discussions, dealings, representations and arrangements relating to the use of the Site and/or the supply of goods by flowerMe.

Any failure on the part of flowerMe to exercise or any delay in exercising any right, power or remedy pursuant to these terms and conditions does not operate as a waiver. If any term of these terms and conditions is unenforceable or invalid, such term(s) will be severed and the remaining terms will continue to bind the parties.

We reserve the right, at our complete discretion, to change these terms and conditions at any time by posting revised terms on the Site. It is your responsibility to check periodically for any changes we may make to these terms and conditions. Your continued use of this site following the posting of changes to these terms and conditions means you accept the changes.

Orders

flowerMe has sole discretion to accept or reject any order or any variation or modification of an order. flowerMe has sole discretion to accept or reject any order cancellation request. flowerMe expressly reserves the right to cancel and/or refund any order placed and/or paid for.

If you have entered into a subscription arrangement to receive flowers on a regular basis (weekly, bi-weekly or monthly) you agree that your subscription will continue until such time as it is cancelled by you. If you wish to cancel your subscription you must do so 1 week prior to your next scheduled delivery.

flowerMe bouquets

flowerMe bouquets are subject of availability at the flower market. If a particular flower is not available we are replacing it with another one with the similar or even greater value.

Price

The prices listed in the website on bouquets and subscriptions are reflecting total prices of the respective product. No taxes are added to your bill. Depending on the delivery addresses an extra services fee might be added to your bill.

Any price indications or price lists provided by flowerMe are subject to alteration at any time without notice. For the avoidance of doubt this includes bouquets, bouquets subscription arrangements or workshops.

Flower Design Workshops

All flowers, materials, vases, etc., will be provided when you attend a workshop. Payment is due in advance and no refund can be given for cancellations/non-attendance as flower order will have been placed in advance.

 

Making a Purchase

To make a purchase of any of our flowers, subscriptions or workshops classes, you will need to fill-in the order forms dedicated to each product: your details, billing address, delivery details, bouquet, subscription or workshop class choice and indicate the payment method. After that you just have to press the "Send bouquet" "Pre-order", "Subscribe" or "Book now" buttons. With this your order is sent. A confirmation e-mail will reach your inbox containing the summary of your order. Shortly after that an invoice containing your payment details indicating your chosen payment method will be sent to your e-mail address to complete the payment. Once payment is successful, we will be taking care of your order and deliver it or secure your place at the workshop class.

Note that when the confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when payment has been processed. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Payments

Note that we do not collect, store or attain any of your credit card or payment details. We do not process any payments via our website.

Security while paying the flowerMe bouquets and subscriptions is our priority. For this we accept payments via secure methods: bank (wire) transfers, payments via PayPal or by credit and debit card via PayPal secure payment. You can choose whichever you feel more confortable with.

If you have chosen to pay your ordered flowers or subscriptions via bank transfer, please transfer the total ordered amount to the following bank account:

On the day we receive your transfer we complete your oder and deliver it within our delivery schedule. Please note that from the time you complete the transfer and the time we receive the money in our bank account will take aproximately one full day, unless you are an OTP Client and the transaction is processed instantly.

Credit and debit cardsecure payment via PayPal

Credit card details are captured within PayPal secure system, and no card details are stored on your computers or computers belonging to flowerMe. You can pay directly with your credit or debit card wihout having to open a PayPal account.

PayPal uses the latest in data encryption and anti-fraud technology to keep your information secure, reducing the risk of online fraud.

PayPal payments

Register your credit card or debit card with your PayPal account. You can pay by simply choosing PayPal at checkout, logging into your PayPal account, and confirming your payment to flowerme@flowerme.hu account. PayPal will complete the process for you, without sharing your financial details with merchants and sellers.

Delivery

Our delivery is limited to inner city few districts in Budapest only. Please check the delivery area here. No deliveries are made outside Budapest or abroad. In exceptional cases, for deliveries outside the defined delivery districts we apply a delivery fee. 

When placing an order for delivery please enter the full address including the postcode of the recipient. We will not be held responsible for flowers that are not delivered due to incorrect details.

The only information sent with the flowers is the personal message. We don't pass on any other details at all and don't send out an invoice or receipt to your recipient.

Orders are delivered ONCE. Should the recipient be away at the time of delivery, we will follow your delivery instructions which goes with your order (if given), or a card will be left stating attempted delivery and will include details of how to collect them.

Flowers sent to hospitals, schools, military & business addresses will be delivered to a main reception.

We deliver every afternoon between 12 p.m. and 7 p.m. Monday to Friday (except public holidays). Deliveries are free of charge in the free delivery zones and is done by bike or on foot whenever possible. Please note that we do not give specific timing slots.

flowerMe will make all reasonable efforts to have the flowers delivered to you on the date they are ordered. However, time is not of the essence under these terms and conditions and flowerMe shall not be liable for any failure to deliver or delay in deliver for any reason.

Refund/Cancelation policy

Customers need to cancel their flower bouquets orders 2 days before the delivery is scheduled to be eligible for a refund.

flowerMe reserves the right to cancel, postpone or reschedule a workshop, based on participation level or instructor illnesses. flowerMe will notify all registered students if there is any change in schedule.

If we cancel a workshop a FULL refund will be given. Please note that this does not include travel or accommodation expenses. 

If students cancel their participation one week before the workshop, 50% of the participation fee will be refunded. In case of later cancellation, no refunds will be made.

Electronic Communications

The communications between you and flowerMe s uses electronic means, whether you visit the Site and send us email communication, or whether flowerMe posts notices on the Site or communicates with you via email. For contractual purposes, you (a) consent to receive communications from flowerMe in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that flowerMeprovides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

Disclaimers

Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. We reserve the right to restrict or terminate your access to the Site or any feature or part of it at any time. flowerMe does not guarantee that prices or promotions displayed on the site are valid at time of ordering.

To the maximum extent permitted by applicable law flowerMe expressly disclaims all warranties of any kind, whether express or implied, including the implied warranties of merchantability, satisfactory quality and fitness for a particular purpose and any warranties that access to the Site will be uninterrupted or error-free, that the site will be secure, or that information on the site will be complete, accurate or timely.

The Site may contain links to other Internet sites which are not controlled, associated or affiliated with flowerMe. flowerMe is in no way responsible for any content appearing on such an Internet site or webpage. flowerMe also cannot accept any responsibility or liability for any loss, damage, legal fees, costs or expense you might incur as a result of use reliance upon the materials which appear at the linked Internet sites or webpages.

Limitation of liability

To the fullest extent permitted by applicable law, you understand and agree that neither flowerMe nor any of its third-party content providers shall be liable for any direct, indirect, incidental, special, consequential, punitive, or any other damages relating to or resulting from your use of or inability to use the Site or from any actions we take or fail to take as a result of electronic mail messages you send us. These include, but are not limited to, damages for errors, omissions, interruptions, defects, delays, computer viruses, your loss of profits, loss of data, unauthorised access to and alteration of your transmissions and data, and other tangible and intangible losses. This limitation applies regardless of whether the damages are claimed under the terms of a contract, as the result of negligence, or otherwise, and even if we or our representatives have been negligent or have been advised of the possibility of such damages.

Use of material from the Site

The website (including all its content) is the property of flowerMe and is protected by copyright and other laws of Hungary and other countries. You agree that you will not use any material from the Site for your personal or a related parties benefit or advantage.

 

PRIVACY POLICY

We take your privacy seriously and we are committed to protecting your privacy. We follow the procedures set out in this policy when using your information.

By using this Site to give us your information you accept the terms of and consent to us using your information in accordance with this policy.

Collection of Your Personal Information

flowerMe may collect personally identifiable information, such as your name, address, phone number. If you order and purchase flowerMe`s products and services, we collect billing information (company name, personal name and address) as well recipient delivery information. This information is used to complete the order and purchase transaction.

Information about your computer hardware and software may be automatically collected by flowerMe. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the flowerMe website.

flowerMe encourages you to review the privacy statements of websites you choose to link to from flowerMe so that you can understand how those websites collect, use and share your information. flowerMe is not responsible for the privacy statements or other content on websites outside of the flowerMe website.

Use of Your Personal Information

flowerMe collects and uses your personal information to operate its website(s) and deliver the services you have requested.

flowerMe may also use your personally identifiable information to inform you of other products or services available from flowerMe and its affiliates. flowerMe may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

flowerMe does not sell, rent or lease its customer lists to third parties.

flowerMe may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. flowerMe may keep track of the websites and pages our users visit within flowerMe, in order to determine what flowerMe services are the most popular. This data is used to deliver customized content and advertising within flowerMe to customers whose behavior indicates that they are interested in a particular subject area.
